Is Delta 9 Legal in Texas? Gummies, Vapes, Flower and Age 21 Rules
Short answer
Partly. Hemp-derived delta-9 THC is legal in Texas for adults 21 and older if the product has no more than 0.3% delta-9 THC by dry weight under Health and Safety Code ch. 443. Delta-9 above that limit is marijuana, delta-9 vapes cannot be sold, and 2026 rules block most smokable hemp.

So, is delta 9 legal in Texas? For hemp products, yes, with firm limits. The same molecule is a crime when it comes from marijuana or when a product is stronger than the hemp definition allows. That split confuses many shoppers, because a gummy from a licensed store and a gram of marijuana can contain the same compound. This guide explains where the line sits, which forms are allowed, and what changed in 2026.
| Hemp delta-9 products | Legal for adults 21 and older at 0.3% delta-9 THC or less by dry weight |
|---|---|
| Delta-9 from marijuana | Illegal, charged under Health and Safety Code § 481.121 |
| Gummies and drinks | Legal if they meet the hemp limit and come from a licensed seller |
| Vapes and cartridges | Cannot be sold under Health and Safety Code § 161.0876 |
| Smokable flower and pre-rolls | Largely blocked since the March 31, 2026 total THC rules |
| Minimum age | 21, with ID checks |
Why is delta 9 legal in Texas?
Because Texas follows the federal hemp definition. The 2018 federal farm bill removed hemp from the federal controlled substances list, and Texas followed with House Bill 1325 in 2019. That law defines hemp as cannabis with a delta-9 THC concentration of no more than 0.3% on a dry weight basis, and it sits in Agriculture Code ch. 121 and Health and Safety Code ch. 443.
That is why delta-9 gummies, drinks and edibles appeared in Texas stores. The law measures concentration, not the total milligrams in a package, so a heavy gummy can contain a large dose while its weight keeps the percentage under 0.3%.
Is delta 9 still legal in Texas in 2026?
Yes, for compliant hemp edibles and drinks. Delta-9 has not been banned, but the rules around it tightened in three steps:
- Age 21: After Gov. Greg Abbott’s September 2025 executive order, state regulators barred sales of consumable hemp to anyone under 21 and required photo ID. Emergency rules began in September 2025 at TABC and on October 3, 2025 at DSHS. TABC adopted permanent rules in January 2026, and the DSHS rules took effect March 31, 2026.
- March 31, 2026: State health department rules began testing for total THC, which counts THCA together with delta-9. A court fight over the rules continues, but they remain enforceable while it plays out.
- July 31, 2026: Delta-8, delta-10, THCP and similar forms became controlled substances. Delta-9 hemp that meets the limit was not part of that change. Our delta-8 guide covers that ban.
A federal change is also coming. Congress rewrote the federal hemp definition in November 2025 so that finished products above a tiny total THC amount no longer count as hemp. Congress delayed most of it from November 12 to December 11, 2026, though synthetic cannabinoids still face November 12. Further changes are being debated, so check back before you rely on this for a business decision.
Are delta 9 gummies legal in Texas?
Yes, if they are made from hemp, stay at or under 0.3% delta-9 THC by dry weight, and are sold by a licensed seller to someone 21 or older. Child-resistant packaging, lab testing and labeling are also required of licensed sellers. Our guide to edibles in Texas explains drinks, chocolates and the dosing questions in more detail.
A gummy that contains delta-8, or that came from marijuana, is a different story. It can be charged as a controlled substance even if the label says “hemp.”
Is delta 9 flower legal in Texas?
Technically only if it passes the total THC test, and almost none does. Smokable hemp flower and pre-rolls usually contain large amounts of THCA, which turns into delta-9 when heated. Since March 31, 2026, the state counts that THCA toward the 0.3% limit, so most flower fails. Retailers pulled it from shelves, and a state appeals court allowed the rules to stay in force. Read our THCA guide for the unsettled possession questions.
Are delta 9 vapes legal in Texas?
No, not for sale. Health and Safety Code § 161.0876 prohibits selling THC vapes and cartridges, which covers delta-9 vape products sold at smoke shops. The broader picture of vape rules, including nicotine, is in our vape guide.
Is delta 9 banned in Texas, or illegal in some cases?
Delta-9 is not banned across the board, but it becomes illegal in several common situations. Marijuana is the clearest case, since it is above the hemp limit by definition. A hemp product that tests over 0.3% is also treated as marijuana. Our marijuana law guide lists the penalties:
| Situation | Likely treatment |
|---|---|
| Compliant hemp gummy, adult 21+ | Legal |
| Under 21 buying hemp THC | Sellers must refuse the sale |
| Product tests above 0.3% | Treated as marijuana, up to 2 oz is a Class B misdemeanor |
| THC vape or cartridge | Sale banned, and concentrates from marijuana can be a felony |
| Delta-8 or THCP | Controlled substance since July 31, 2026 |
Is Mood legal in Texas, and what about D9?
“D9” is shorthand for delta-9, so the answer for D9 products is the same as above. Brand names such as Mood do not change the law. What matters is the ingredient, the lab result, the seller’s license and your age. Check for a certificate of analysis, and do not buy any product that lists delta-8 or does not show test results.
Real situations
You buy gummies from a gas station
Check that the seller asks for ID and that the label shows a lab report. A store that skips both is a warning sign. The seller, not the buyer, faces the license penalties.
You are 19 and a store sells to you
The sale is a violation by the store, which can lose its license. Do not assume you are safe, though, since age rules and local enforcement vary and a product may also be illegal for other reasons.
You drive after a gummy
Legal hemp does not protect you on the road. Driving while impaired by any substance can be DWI under Penal Code § 49.04.
Delta-9 laws compared with neighboring states
| State | Delta-9 situation |
|---|---|
| Texas | Hemp delta-9 edibles and drinks allowed for adults 21+, vapes and most flower blocked |
| New Mexico | Cannabis legal for adults 21+ through licensed stores |
| Oklahoma | Medical marijuana program with licensed dispensaries |
| Louisiana | Hemp THC sales are regulated and limited |
| Arkansas | Medical marijuana program, hemp THC products tightly restricted |
Frequently asked questions
Is delta-9 legal in Texas right now?
Yes, in hemp edibles and drinks that stay at or under 0.3% delta-9 THC by dry weight and are sold to adults 21 and older. Delta-9 from marijuana, over-limit products, vapes and most smokable flower are not legal to sell or possess.
Is delta 9 THC legal in Texas if it comes from hemp?
Yes. Hemp-derived delta-9 is legal when the product meets the 0.3% limit and the seller holds the right state license. The source plant matters, because the same compound from marijuana is a controlled substance.
Can you get in trouble for delta-9 gummies in Texas?
Rarely for a compliant product, but it can happen. A gummy that tests over the hemp limit or contains delta-8 can lead to a drug charge. Keep the packaging and lab report, and do not share products with anyone under 21.
Do delta-9 products show up on a drug test?
Yes. Legal hemp THC can trigger a positive test because standard tests look for THC metabolites. Texas law does not shield you from a workplace policy, so check your employer’s rules first.
Is CBD different from delta-9?
Yes. CBD is a separate compound without the intoxicating effect, and hemp CBD is legal in Texas under the same 0.3% rule. See our CBD guide for oils, creams and the age 21 rule.
Could Texas ban delta-9 in 2027?
It could. The Legislature meets again in January 2027, and Sen. Charles Perry has said he plans to file a THC ban bill after the governor vetoed a ban in 2025, while other lawmakers favor regulation instead. Nothing is law until it passes and is signed. Our Texas THC ban guide tracks the latest.
