Are Vapes Banned in Texas? What Senate Bill 2024 Covers
Short answer
Partly. Texas has not banned vaping, and adults 21 and older can still buy nicotine vapes. Senate Bill 2024 bans selling vapes made in China, vapes with THC or other cannabinoids, vapes disguised as other items, and youth-appealing packaging. Violations are a Class A misdemeanor under Health and Safety Code § 161.0876.

Are vapes banned in Texas? Not as a category. An adult can walk into a licensed store and buy a nicotine vape, but a 2025 law shut off sales of many popular disposable brands and of every vape that contains THC. The result is a patchwork that confuses shoppers and store clerks alike.
| Nicotine vapes for adults | Legal for buyers 21 and older |
|---|---|
| Vapes made wholly or partly in China or another foreign adversary | Cannot be sold, marketed or advertised since September 1, 2025 |
| THC, CBD or other cannabinoid vapes | Cannot be sold, unless prescribed |
| Vapes shaped like toys, phones or school supplies | Cannot be sold |
| Flavored vapes | No statewide flavor ban |
| Retailer requirement | Texas Comptroller e-cigarette retailer permit |
| Main laws | Health and Safety Code §§ 161.082, 161.0876, Health and Safety Code ch. 147 |
Are vapes banned in Texas?
No, but parts of the market are. Texas lets licensed retailers sell nicotine vapes to adults, and it does not ban vaping itself. What changed on September 1, 2025 is which products a store may sell, under Senate Bill 2024.
The Texas Comptroller of Public Accounts said there is no grace period. A store that kept selling a banned product after that date was already in violation.
Is vaping illegal in Texas for adults?
No. Using a nicotine vape is legal in Texas if you are 21 or older, except where city rules, schools or property owners prohibit it, and the statute at the center of the debate targets sellers, not users. The offense in Health and Safety Code § 161.0876 is marketing, advertising, selling, offering for sale or causing a banned product to be sold. We found nothing in the text that makes an adult’s possession of a nicotine vape a crime on its own.
Age is the firm line. Texas bars selling vapes to anyone under 21 under Health and Safety Code § 161.082, and a buyer under 21 can be fined up to $100. Our guide to the legal age to buy cigarettes in Texas covers the military ID exception and the full penalty table.
What does Senate Bill 2024 ban?
Senate Bill 2024 made it a crime to market, advertise or sell an e-cigarette product that falls into any of four groups. The law defines e-cigarette to include the liquid or material in the device, whether or not it contains nicotine.
- Origin: products wholly or partly manufactured in China or in a country the U.S. Secretary of Commerce lists as a foreign adversary, or marketed as made there.
- Disguised shapes: devices designed to look like a highlighter, pen, pencil, smartphone, smartwatch, headphones, clothing, a backpack, a cosmetic such as lipstick, or a toy.
- Youth-appealing packaging: containers with a cartoon-like character, a lookalike of a youth brand, a celebrity’s image or name, or a picture of a food such as candy or juice.
- Other substances: products that contain, or are marketed as containing, cannabinoids, alcohol, kratom, kava, mushrooms, tianeptine, or their derivatives.
The law excludes prescription medication and other prescribed substances unrelated to smoking cessation. It also raised the penalty from a Class B to a Class A misdemeanor.
Are disposable vapes banned in Texas?
Not all of them. Texas has no ban on disposable vapes as a type, but the origin rule removes most of the best-known brands from legal sale. Many popular disposables come from Chinese manufacturers, and the FDA described the Geek Bar and Elf Bar products it warned retailers about in December 2024 as owned by Chinese manufacturers.
That is why people search for a Geek Bar ban in Texas. There is no law naming the brand. The brand becomes unsellable when the device is wholly or partly manufactured in China, and the Comptroller says manufacturing includes filling a device and packaging a pre-filled one.
If a pre-filled device or pod is labeled as made in China or another foreign adversary, the Comptroller presumes it was manufactured there. A seller can overcome that only if the packaging clearly states the product was blended, poured and packaged in non-adversary countries.
What vapes are not banned in Texas?
A vape is lawful to sell if it avoids all four groups above and the store holds the right permit. In practice that means a nicotine product made, filled and packaged outside China and the other listed countries, in ordinary packaging, in a normal device shape, sold to a buyer who is 21 or older.
Federal law adds a second filter. The FDA must authorize a vape before it can be legally marketed in the United States. On May 5, 2026, the FDA authorized four Glas pods, which brought its total to 45 authorized e-cigarette products. The FDA’s list showed 48 by late August 2026. Unauthorized products can be seized or pulled by federal regulators even when a state allows the sale.
Mixed-origin devices are the gray area. The pages we reviewed do not settle every case where hardware and liquid come from different countries, so a retailer with a question can ask the Comptroller before stocking the item.
Are flavored vapes banned in Texas?
No. Texas does not ban flavored vapes as such, and Senate Bill 2024 says nothing about flavors. Flavor names can still cause trouble through the packaging rule. A box that shows a candy or juice image, or uses a cartoon character, cannot be sold even if the liquid inside is otherwise legal.
Are THC vapes legal in Texas?
Not to sell. Since September 1, 2025, a store that sells a vape containing THC or any other cannabinoid commits a Class A misdemeanor. The ban applies to hemp-derived products, including delta-8, delta-9 and THCA cartridges, whether or not the hemp itself is legal.
A second problem sits on top of the sales ban. A state health department scheduling of delta-8, delta-10 and similar THCs took effect July 31, 2026, after the Texas Supreme Court sided with the state, and a cartridge of marijuana oil is a Penalty Group 2 substance. Our Texas THC ban guide and the page on the THCA ban in Texas explain each layer.
CBD vapes are a question the law does not answer cleanly. The statute lists cannabinoids without carving out CBD, so on its words a vape containing CBD falls inside the ban. We found no Comptroller guidance that exempts it, so a store that sells CBD vape liquid is taking a risk.
Penalties for breaking Texas vape laws
| Who | Violation | Penalty |
|---|---|---|
| Seller or store | Selling or marketing a banned vape product (§ 161.0876) | Class A misdemeanor: up to 1 year in jail, fine up to $4,000 |
| Retailer | Selling e-cigarettes without a Comptroller permit | Penalty of up to $2,000, possible criminal charges, and each day counts as a separate violation |
| Seller or employee | Selling a vape to someone under 21 (§ 161.082) | Class C misdemeanor: fine up to $500 |
| Buyer under 21 | Buying or possessing a vape (§ 161.252) | Fine up to $100, plus a tobacco awareness program or community service |
| Student | Possessing or using a vape at school or within 300 feet of campus | Removal from class and placement in a disciplinary alternative education program |
The school penalty comes from House Bill 114, effective September 1, 2023, as described in a Department of State Health Services report. A Class A misdemeanor sentence is set by Penal Code § 12.21.
Where you can vape: Houston, Dallas, Austin, San Antonio and Fort Worth
Where an adult may vape depends mostly on the city. The five largest cities each folded e-cigarettes into their smoking rules at different times.
- Houston: City Council voted in March 2022 to ban vaping everywhere smoking is banned, including enclosed public places, workplaces, areas near building entrances and outdoor seating at spectator events.
- Dallas: The rule took effect December 11, 2025. It covers bars, restaurants, workplaces, public transit and parks, and bans vaping within 15 feet of public building entrances. Media reports put fines at up to $500.
- Austin: The city’s ban applies in public spaces such as city buildings, workplaces, restaurants and parks.
- San Antonio: The amendment took effect January 1, 2025. Vaping is banned wherever smoking is, and businesses must post a sign showing both a cigarette and an e-cigarette.
- Fort Worth: Council amended its ordinance on December 12, 2017, and the change took effect March 12, 2018. It covers restaurants, bars and bingo halls.
Permits, taxes, vending machines and advertising
Retailers need an e-cigarette retailer permit from the Comptroller, including those who sell online, by phone or by mail order. The fee is $180 for a two-year period, or $90 if the location already holds a cigarette, cigar or tobacco permit. Senate Bill 248 created the permit in 2021.
The Comptroller says vending machines do not qualify for a permit, which means a vape vending machine has no lawful permit path. Texas also does not apply its cigarette excise tax to e-cigarettes, but sales tax applies to them.
Real situations under Texas vape law
Your favorite disposable vanished from the shelf
If it was made or filled in China, the store can no longer legally sell it. The store did not choose to hide it. It risked a Class A misdemeanor charge, and an employee who sells it can be the one charged.
You drive home with a THC cartridge from New Mexico
The Texas retail ban does not describe your trip, but the cartridge itself is the problem. Marijuana oil is charged as a controlled substance, so a cartridge can bring felony charges depending on the amount. Driving after using it can also lead to a DWI under Penal Code § 49.04. Our cannabis, THC and substances guides explain the charges.

What happens next for vapes in Texas
The foreign-origin rule is in force while a court challenge continues. Vape companies and the Vapor Technology Association sued. A federal judge let the challenge proceed in December 2025, and the Comptroller appealed to the Fifth Circuit on sovereign immunity. We found no ruling blocking the law as of October 28, 2026.
The Legislature meets again in January 2027, and vape and hemp bills are likely to return.
Frequently asked questions
Are vapes illegal in Texas?
No. Vapes are legal for adults 21 and older when they are sold by a permitted retailer. Texas bans the sale of vapes made in China or another foreign adversary, vapes with cannabinoids, and vapes disguised as other items, with a Class A misdemeanor penalty for sellers under Health and Safety Code § 161.0876.
Are THC vapes legal in Texas?
No, not to sell. Since September 1, 2025, selling a vape that contains THC or another cannabinoid is a Class A misdemeanor, with an exception for prescribed products. A state scheduling of delta-8 and delta-10 also took effect July 31, 2026, and marijuana oil can bring felony charges.
What vapes are not banned in Texas?
Nicotine vapes that are not wholly or partly made in China or another foreign adversary, have no cannabinoids, and come in a normal device and plain packaging. They must be sold by a permitted store to a buyer who is 21 or older. Check the label for the country where the product was filled.
Are disposable vapes banned in Texas?
No, but many are unsellable. Texas has no rule against disposables as a type, yet the origin rule blocks any device made or filled in China or another foreign adversary. The Comptroller treats a label showing that origin as proof, unless the packaging clearly shows non-adversary blending and packaging.
Are flavored vapes banned in Texas?
No. Texas has no statewide ban on flavored vapes. The law does bar packaging that shows cartoon characters, celebrity names or images, or food such as candy or juice, so a flavored product in that kind of box cannot be sold.
