THCA Ban Texas: Is THCA Legal in 2026?

Short answer

Partly. Most THCA flower cannot pass the Texas total THC test, so licensed stores should not sell it, but no court has said whether simply possessing it is a crime. Delta-8 and delta-10 became controlled substances on July 31, 2026, and THCP is likely covered. See 25 Texas Administrative Code § 300.101.

The THCA ban in Texas is not a single law, and that is why so many people get a different answer from every smoke shop, news story and police department. THCA is a legal gray area in Texas right now, and the gray comes from two sets of state rules that point in opposite directions. One set treats hemp-derived cannabinoids as legal. The other treats THCA as if it were delta-9 THC.

This page explains what the rules say, what is unsettled, how police in different Texas cities are handling it, and what could change next. For the wider picture of every hemp product, see our guide to the Texas THC ban.

Is THCA legal in Texas?

It depends on whether you are talking about buying, selling or having it, and the law is unsettled on the last one. A licensed hemp store cannot lawfully sell THCA flower that fails the state’s total THC test, and most THCA flower fails it. Whether you can be charged with a crime for having a bag of it at home has not been decided by any court.

The reason is simple chemistry. THCA is the raw form of THC found in the hemp plant. It does not cause a high until it is heated, and then it converts into delta-9 THC. Texas hemp law only allowed products with up to 0.3% delta-9 THC, so for years sellers pointed to the low delta-9 number on a lab report and ignored the THCA.

The Department of State Health Services (DSHS) closed that loophole with rules that took effect March 31, 2026. Those rules count THCA when they measure how much THC a product has. The formula is total THC = (0.877 × THCA) + THC, in 25 Texas Administrative Code § 300.101.

Is THCA banned in Texas?

Not by name. No Texas statute says “THCA is banned,” and the DSHS hemp rules do not list it as a banned substance. The rules define THCA only as the acid form of THC and then count it toward the total THC limit.

Here is how that works with a real number. Say a bag of flower tests at 20% THCA and 0.2% delta-9 THC. The math is 0.877 × 20, which is 17.54, plus 0.2, for a total THC of 17.74%. The legal ceiling is 0.3%, so the flower is nearly 60 times over the limit even though the delta-9 number alone looks fine.

That is why people say THCA flower is “banned” in practice. A product like that cannot meet the standard for a consumable hemp product, and 25 Texas Administrative Code § 300.302 bars selling, offering, possessing, distributing or transporting a consumable hemp product that is not shown by lab testing to meet the limit. By its words that section applies to “a person,” and it lists possession, yet DSHS says it does not regulate private possession and no court has applied the rule to a buyer.

Is THCA flower legal in Texas?

Licensed stores cannot lawfully sell most THCA flower, and making smokable hemp in Texas is flatly prohibited. Under Health and Safety Code § 443.204, rules for consumable hemp must prohibit processing or manufacturing hemp products for smoking, and 25 Texas Administrative Code § 300.104 says the same thing.

The Fifteenth Court of Appeals decided on June 5, 2026 not to keep a trial court’s block on the March rules in place, and it denied rehearing on June 26. The state’s appeal, DSHS v. Texas Hemp Business Council, No. 15-26-00099-CV, is still pending, so the rules remain enforceable while the lawsuit goes on.

Possession is the harder question. DSHS has said it “does not regulate the possession of consumable hemp products” and told reporters to ask police. The Department of Public Safety said it does not decide legality and that courts do. A Bell County deputy who also works with the Texas Municipal Police Association called the situation “a mess” and asked state officials for clarity.

Why the law is so unclear: two rules that conflict

The conflict is between the 2019 hemp law and the 2021 drug schedule. In 2019, House Bill 1325 legalized hemp and wrote in Health and Safety Code § 443.204 that hemp-derived cannabinoids are not treated as controlled substances. That law covers the plant’s acids, including THCA, as long as delta-9 stays at or under 0.3%.

In 2021, DSHS rewrote its controlled substances schedule to reach tetrahydrocannabinols other than up to 0.3% delta-9 in hemp, plus synthetic equivalents. A Travis County injunction blocked that change for years. On May 1, 2026, the Texas Supreme Court reversed the injunction in Texas Department of State Health Services v. Sky Marketing Corp., No. 23-0887, and DSHS began enforcing the definitions on July 31, 2026.

The Supreme Court held that the vendors’ claims against DSHS failed and reversed the injunction. The opinion was about manufactured delta-8 and did not mention THCA or THCP. Until a court decides whether the schedule overrides the hemp exemption for THCA, nobody can say for sure that having THCA flower is legal or illegal.

Is THCP legal in Texas?

Almost certainly not. Since July 31, 2026, DSHS enforces a schedule covering THCs other than hemp’s 0.3% delta-9, and reporting on the rule lists delta-8, delta-10 and THCP as forms that are no longer lawful hemp products. The schedule text itself does not name THCP.

One detail matters here. The DSHS notice does not name every banned product, because DSHS said those terms are not standardized. It describes THCs other than delta-9 and the synthetic equivalents of what the cannabis plant contains. We found no court ruling that applies that language to THCP specifically, so the safest reading is that THCP is covered.

Austin police have said delta-8 possession will be treated as a state jail felony, which carries 180 days to 2 years in a state jail and a fine up to $10,000 under Penal Code § 12.35. Prosecutors decide the actual charge in each case.

Are THCA vapes legal in Texas?

No. Senate Bill 2024 took effect September 1, 2025, and it makes selling or marketing an e-cigarette product that contains any cannabinoid a Class A misdemeanor under Health and Safety Code § 161.0876. That covers THCA vape cartridges and disposable pens. A Class A misdemeanor carries up to 1 year in jail and a fine up to $4,000.

The law excludes prescription medication and other prescribed substances. A THCA cartridge from a smoke shop or an online seller does not fit that exception. Many of these products also contain delta-8 or THCP, which adds a second problem.

Is THCA illegal in Texas now?

For stores, the answer is mostly yes. For buyers, the honest answer is that it is unclear. The March 31, 2026 rules are in force, the July 31, 2026 schedule is in force, and police are enforcing them differently from one city to the next.

How police in different Texas cities are handling THCA

  • Austin: Police said their policy is not to arrest or seize hemp flower or concentrate that is at or under the 0.3% delta-9 limit. That is a policy, not a change in the law.
  • Travis County Sheriff: A spokesperson said enforcement is up to the deputy and that every instance is unique. Deputies use test pouches to check the 0.3% threshold.
  • Dallas and Fort Worth: Dallas police said the DSHS rule treating THCA as delta-9 does not say possession is automatically illegal. Fort Worth police said possessing less than 0.3% delta-9 is legal and did not address THCA directly.
  • Round Rock and Hays County: Round Rock police pointed to a state law library guide that links to a defense lawyer’s blog concluding THCA is illegal. The Hays County Sheriff’s Office said THCA “will not be legal according to the State Department,” while Deputy Alyssa Davenport said anything labeled hemp or at or under 0.3% delta-9 would be treated as legal.

We did not find a public statement on THCA from Houston or San Antonio police, so we are not describing their approach. Travis County District Attorney José Garza said the risk of arrest is real and also called enforcement incredibly difficult because of the lack of clarity.

Is THCA still legal in Texas after the July 31 change?

The July 31 change did not name THCA, but it matters for THCA products in two ways. It put delta-8 and delta-10, and reportedly THCP, in the controlled substances schedule, and many THCA vapes, gummies and concentrates are blended with those cannabinoids. A product that mixes THCA with one of them has a bigger legal problem than a plain flower product does.

Plain THCA flower with no added cannabinoids sits in the unsettled zone described above. The 2019 hemp exemption protects it on paper, the 2026 total THC rule restricts its sale, and the schedule may or may not reach it. A hemp business group has also sued in federal court, and a federal judge in Galveston denied an emergency order in August 2026 while the request for a longer injunction stays pending.

Will THCA be banned in Texas?

It might be settled in 2027, one way or the other. Three things could decide it: the Fifteenth Court of Appeals, the courts hearing the challenges to the July 31 schedule, and the Legislature. Oral argument in the DSHS rules appeal is set for December 8, 2026, and the 90th Legislature convenes January 12, 2027, with bill prefiling opening November 9, 2026.

Lawmakers did not pass a hemp ban in 2025. Gov. Greg Abbott vetoed Senate Bill 3 on June 22, 2025, and two special sessions that summer produced no new hemp law. Hemp is likely to come up again in 2027.

Congress is moving in the same direction. A federal law changed the definition of hemp so that finished products with more than 0.4 milligrams of total THC per container no longer count as hemp. A law signed September 2, 2026 moved most of that change to December 11, 2026, and cannabinoids the plant cannot make naturally lose hemp status on November 12, 2026.

Real situations involving THCA in Texas

You buy THCA flower at an Austin smoke shop

The store may be breaking the total THC rule even if you are the one paying. Austin police have said they do not arrest or seize flower that is at or under 0.3% delta-9, so a stop is less likely there than in other cities. A different department could treat the same bag differently, and an arrest is possible even if the case is later dropped.

You are stopped in Hays County with a jar of THCA flower

The officer may test it for delta-9 and, in some departments, treat a low result as legal hemp. In another department the officer may treat THCA as illegal under the state’s schedule. Keep it in its original package with the lab report. The package label does not end the stop, but it gives the prosecutor facts to work with.

You drive after using THCA

A legal product does not protect you on the road. Driving while intoxicated by alcohol or any drug or substance is DWI under Penal Code § 49.04. Read our driving and vehicle guides for how Texas DWI works.

Myths vs. facts about the THCA ban in Texas

MythFact
“THCA is legal because the delta-9 number is under 0.3%.”Since March 31, 2026, Texas counts THCA in total THC, so most flower is over the limit.
“Texas made THCA a felony.”No statute or court has said that. Felony charges have been described for delta-8, and THCA possession is unsettled.
“A hemp label protects you from arrest.”Police departments treat labels differently, and a label does not stop an officer from testing or seizing a product.
“Federal law protects THCA.”The federal hemp definition is also tightening, and a federal judge declined an emergency order in the Texas challenge.
“A THCA vape is fine because it is hemp.”Selling any cannabinoid vape is a Class A misdemeanor under Senate Bill 2024.

What to do if you are stopped or affected

Keep every product in its original packaging, and keep the lab report for each one. Do not consent to a search, and do not volunteer where you bought it. If you are charged, speak with a Texas-licensed criminal defense attorney before your first court date, because the hemp exemption may be a defense that depends on how the court reads it.

If you sell hemp, check your DSHS license, your ID-check process and your test results against the current rules. You can also read the broader cannabis, THC and substances guides as each change develops.

Frequently asked questions

Is THCA legal in Texas?

Partly. Licensed stores cannot lawfully sell THCA flower that fails the state’s total THC test, and most does. Whether having it is a crime is unsettled, because DSHS says it does not regulate possession and no court has ruled. Delta-8 and delta-10 are controlled substances since July 31, 2026, and THCP is likely covered.

Is THCA banned in Texas?

Not by name. The DSHS hemp rules count THCA toward total THC using the formula 0.877 × THCA plus THC, with a 0.3% limit. That makes nearly all THCA flower non-compliant for sale. Smokable hemp also cannot be manufactured in Texas under Health and Safety Code § 443.204.

Is THCP legal in Texas?

Almost certainly not. Since July 31, 2026, DSHS enforces a schedule covering THCs other than hemp’s 0.3% delta-9, and reporting lists THCP among the forms affected. The schedule does not name THCP, and we found no court ruling on it alone. Treat it as illegal to sell or possess.

Is THCA illegal in Texas now?

For retailers, selling most THCA flower breaks the state rules. For buyers it is unclear. DSHS does not regulate private possession, DPS says courts decide, and Austin, Dallas, Fort Worth, Round Rock and Hays County police describe different approaches. A court has not yet settled the question.

Is THCA still legal in Texas?

Parts of the market still operate, but the legal footing is weaker. The total THC rule has been back in force since June 5, 2026, and sellers risk license action. The December 8, 2026 appeal hearing and the 2027 legislative session could change the answer, as could the federal hemp change on December 11, 2026.

Are THCA vapes legal in Texas?

No. Senate Bill 2024 makes it a Class A misdemeanor to sell or market a vape that contains any cannabinoid, with an exception for prescribed products. The ban has applied since September 1, 2025. Many THCA cartridges also contain delta-8 or THCP, which are controlled substances.

Is THCA flower legal in Texas?

Stores cannot lawfully sell flower that fails the total THC test, and nearly all THCA flower does. You must be 21 or older to buy any hemp product. Having a small amount is a gray area that police handle differently by city, so keep the lab report and the original package.

Will THCA be banned in Texas?

It could be. A court may rule on the DSHS rules after the December 8, 2026 argument, and the Legislature meets in January 2027. Federal hemp rules also change on December 11, 2026. No new Texas statute naming THCA has passed so far.
