Is Porn Illegal in Texas? Age Checks, Prostitution and Sex Laws
Short answer
No. Adults can legally watch porn in Texas. The state requires adult sites to verify age under Civil Practice and Remedies Code ch. 129B, which the U.S. Supreme Court upheld in 2025. Prostitution, sharing intimate images without consent, and any sexual material involving minors are crimes.
Last verified October 25, 2026 against current Texas law
Is porn illegal in Texas? For adults, no. Texas has not made it a crime to watch, own or pay for legal adult content, even though headlines about a Texas porn ban make it sound that way. What Texas did is require adult websites to check that visitors are 18 or older, and some big sites chose to block Texas instead. Other parts of Texas sex law, such as prostitution and intimate image abuse, do carry real criminal penalties.
This page explains the age verification law, the court fight over it, the rules on prostitution, revenge porn and deepfakes, and the old Texas law on sex toys.
| Is porn illegal in Texas? | No. Legal adult content is lawful for adults to watch and own |
|---|---|
| Age verification | Required for covered adult sites under Civil Practice and Remedies Code ch. 129B (HB 1181, effective September 1, 2023, but blocked in court until a Fifth Circuit ruling in 2024) |
| Court status | U.S. Supreme Court upheld the age verification requirement 6-3 on June 27, 2025 |
| Prostitution | Illegal. Selling is a Class B misdemeanor, and paying is a state jail felony |
| Sharing intimate images without consent | State jail felony under Penal Code § 21.16 |
| Sexual material involving minors | Always illegal, a felony under Penal Code § 43.26 |
Is porn banned in Texas?
No. Texas does not ban adult content for adults. House Bill 1181 (2023) puts a duty on websites, not on viewers. A commercial site that knowingly publishes content more than one-third of which is sexual material harmful to minors must verify that each visitor is at least 18, using digital identification, a government ID or a commercially reasonable method based on public or private transactional data.
The Texas attorney general enforces the law. Civil penalties can reach $10,000 per day for a site that does not verify ages, up to $10,000 per instance for keeping identifying information, and up to $250,000 if a minor gets access because of the violation. Search engines and internet service providers are not liable just for providing access to other sites.
Some companies decided that blocking Texas was easier than collecting IDs. After the March 2024 Fifth Circuit ruling, some major sites blocked Texas users. That is a business choice by the site, not a state ban on the content.
Is watching porn illegal in Texas?
No. Nothing in the Texas Penal Code makes it a crime for an adult to view lawful adult content in private. The age verification law penalizes the website operator. It does not create an offense for the person watching, and I found no Texas statute that makes using a VPN a crime.
The line changes when the content changes. Possessing sexual material that shows a child is a felony under Penal Code § 43.26, and the law also covers computer-generated images that appear to show a child. Texas treats these cases very seriously, and a deleted file does not always end the risk. For the age rules that apply to sexual conduct with young people, see our guide to the legal age of consent in Texas.
Did Texas ban porn? The timeline
The short version: Texas passed an age check law, lost in a trial court, won on appeal, and then won at the nation’s highest court.
| Date | Event |
|---|---|
| August 31, 2023 | A federal judge blocks the law before it starts |
| September 1, 2023 | HB 1181 takes effect by its terms, creating Civil Practice and Remedies Code ch. 129B, but the injunction keeps it from being enforced |
| March 7, 2024 | The Fifth Circuit rules Texas can enforce the age verification requirement |
| June 27, 2025 | In Free Speech Coalition v. Paxton, the U.S. Supreme Court upholds the HB 1181 age verification requirement by a 6-3 vote under intermediate scrutiny |
| September 1, 2025 | HB 581 extends the chapter to tools that create sexual images of recognizable real people, and SB 441 expands civil liability for deepfake intimate images |
The Supreme Court did not say Texas can ban adult content. It said an age check is a small burden on adults when it protects children. Our Texas legal news hub follows later changes.
Is OnlyFans banned in Texas?
No. No Texas law bans OnlyFans or paid adult content between consenting adults. Whether a given platform must run age checks under HB 1181 depends on the one-third test, which is a fact question for the attorney general or a court, not something this page can decide for any single site.
Creators have a separate duty. Anyone who appears in sexual content must be an adult who consented, and HB 581 requires the AI tools it covers to confirm that a real person used as a source is 18 or older and agreed to the use of their face and body.
Is prostitution legal in Texas?
No. Prostitution is illegal everywhere in Texas, including Houston, Dallas, Austin, San Antonio and Fort Worth, and no county has a legal brothel. The Penal Code treats the seller, the buyer and the person who profits differently, and the buyer faces the harshest charge.
| Offense | Statute | Level |
|---|---|---|
| Selling sex (prostitution) | Penal Code § 43.02 | Class B misdemeanor; Class A with 1 or 2 priors; state jail felony with 3 or more |
| Paying for sex (solicitation) | Penal Code § 43.021 | State jail felony; third-degree felony with a prior; second-degree felony if the person is under 18 |
| Soliciting within 1,000 feet of a school | Penal Code § 43.021(b-1) | Punishment goes up one category |
| Promoting prostitution | Penal Code § 43.03 | Third-degree felony; second-degree with a prior conviction; first-degree if the person is under 18. Aggravated promotion (§ 43.04) is a first-degree felony |
The buyer penalty surprises many people. Since September 1, 2021, the first offense of paying for sex is a state jail felony, which carries 180 days to 2 years. A person who sold sex because they were a trafficking victim has a defense under Penal Code § 43.02. If you or someone you know is being forced into sex work, the National Human Trafficking Hotline can help.
Is revenge porn illegal in Texas?
Yes. Sharing someone’s intimate images without consent is a state jail felony under Penal Code § 21.16 when the person intended to harm them, the material was private, it caused harm and it identifies the person. It is not a defense that the person sent you the photo or agreed to be filmed. Threatening to share such material to get something is also covered, and so is running a site that promotes it.
Fake images count too. Producing or sharing sexually explicit deepfakes of a real person without consent is a crime under Penal Code § 21.165, a Class A misdemeanor that becomes a third-degree felony if the person shown is under 18 or the offender has a prior conviction. A victim can also sue under Civil Practice and Remedies Code ch. 98B, and SB 441 (effective September 1, 2025) expanded that civil claim to cover AI-generated intimate images, including nudify apps. Websites that do not remove such material within 72 hours of a request can be liable.
What is the dildo law in Texas?
Texas still has a law on the books against promoting “obscene devices,” but the Fifth Circuit held it unconstitutional as applied to sales for private use. Under Penal Code § 43.23 and the definitions in § 43.21, selling a device made to stimulate human genitals was a crime. In Reliable Consultants, Inc. v. Earle (February 12, 2008), a 2-1 panel ruled that the ban, as applied to sales for private use, violated the same privacy principle behind Lawrence v. Texas. Adult stores now sell the products openly.
The same section still punishes selling obscene material, which is judged by the legal obscenity test and is a different matter from ordinary adult content.
Real Texas situations
You live in Houston and a site shows an age check page
You are not in trouble. The site is meeting its legal duty. Providing ID to a verification service is your choice, and the site cannot keep the identifying information under the law.
Your ex posts private photos on social media in Dallas
That may be a state jail felony under Penal Code § 21.16. Save screenshots with dates, report the post to the platform, and file a report with police. A civil lawsuit may also be possible.
You are approached for a paid date in Austin
Agreeing to pay is the crime, even if no sex happens. A buyer can face a felony charge, which is why stings often target buyers.

How neighboring states handle adult site age checks
Texas is not alone. Louisiana’s law took effect January 1, 2023, Arkansas followed in 2023, and Oklahoma’s took effect November 1, 2024. Each uses a different enforcement method, mostly private lawsuits, while Texas gives enforcement to the attorney general. New Mexico was not on the lists I checked, so this page does not say what it requires.
