Is Delta 8 Legal in Texas? 2026 Ban, Penalties and What Is Still Legal

Short answer

No. Delta-8 THC is not legal in Texas. Since July 31, 2026, the state treats manufactured delta-8 as a controlled substance, and only trace amounts a hemp plant makes naturally are exempt. Austin police say they will treat possession as a state jail felony.

So, is delta 8 legal in Texas? Not anymore. For years, delta-8 gummies, vapes and pens sat on smoke shop shelves because of a gap in the 2019 hemp law. A Texas Supreme Court ruling in 2026 closed that gap, and the state began enforcing the change on July 31, 2026. What follows covers what is banned, what still is legal, how police are treating possession, and what could change next.

Is delta 8 legal in Texas in 2026?

No. DSHS says delta-8 THC is a controlled substance in Texas, and press reports describe it as placed on the state’s Schedule I list. The change took effect on July 31, 2026, and it applies in every Texas city and county.

The Department of State Health Services (DSHS) says only trace amounts of delta-8 that the hemp plant produces naturally are allowed in a consumable hemp product. Products labeled as delta-8, or shown to hold more than trace amounts, may be detained and referred to law enforcement.

Delta-8 is not a new target. DSHS listed it in a 2021 update to the state schedule, and a court order kept that update on hold for more than four years. When people ask about the Texas delta 8 ban, they mean the 2026 ruling that ended that hold.

Texas delta 8 ban timeline

The ban came from a court case and an agency rule, not from a new bill. These are the dates that matter.

What did the Texas Supreme Court decide about delta-8?

The court sided with the state. In its May 1, 2026 opinion in Sky Marketing Corp., it reversed the temporary injunction that had blocked DSHS since 2021. It held that the health commissioner lawfully changed the Schedule I terms under Health and Safety Code § 481.034(g), and that the change does not conflict with the 2019 Texas hemp law.

The court held that sovereign immunity applied to the vendors’ claims and that the amendments do not conflict with the 2019 Texas Farm Bill, which is the state hemp law behind House Bill 1325. Press reports say the case can still proceed without the order that stopped enforcement, but the opinion does not order a new trial. The ban applies in the meantime.

Is delta 8 illegal in Texas to possess, or only to sell?

Both are risky, and the risk is higher for sellers. Businesses that sell delta-8 can lose their consumable hemp licenses and face criminal charges for distributing a controlled substance. A buyer or carrier faces possession charges, and how they are handled varies by place.

Austin police said they will treat possession of delta-8 as a state jail felony, which carries 180 days to 2 years in a state jail and a fine up to $10,000 under Penal Code § 12.35. They said packaging will not make a product labeled delta-8 legal. They also advised keeping legal hemp in its original packaging so officers can see the stated delta-9 amount.

Whether a person is charged is a separate question. Prosecutors decide, and no Texas statute names delta-8 in its criminal penalty list. Texas criminal penalties come from Penalty Groups, and Health and Safety Code § 481.103 (Penalty Group 2) lists tetrahydrocannabinols other than marihuana and their isomers. That is the most likely route for a charge, but the list does not name delta-8, and no court has yet decided how it applies. The Schedule I label is DSHS’s civil schedule, while criminal penalties come from the Penalty Groups.

Is delta 8 banned in Texas for medical patients too?

Delta-8 itself is not part of the medical program. Registered patients in the Texas Compassionate Use Program can get low-THC cannabis from a licensed dispensing organization under Occupations Code ch. 169. A hemp-derived delta-8 product from a smoke shop is not that, and a patient card does not cover it. See our guide on whether weed is legal in Texas for how the medical program works.

Is delta 10 legal in Texas?

No. The DSHS rule covers THC forms other than delta-9, and press coverage of the July 31 change describes the ban as reaching delta-8, delta-10, THCP and other synthetically created THC forms, with delta-9 under 0.3% as the exception.

The rule text does not list every product by name, because the names of these compounds are not internationally standardized. It describes THC forms other than delta-9 and synthetic equivalents of what the cannabis plant contains. HHC and THC-O are not named in the sources we reviewed, and we found no official Texas statement clearing them. Treat them as unsettled and risky.

Are delta 8 gummies, vapes and pens legal in Texas?

No. Delta-8 gummies fall under the same rule as every other delta-8 product, and a gummy label that says hemp-derived does not change that. Our guide on whether edibles are legal in Texas explains which gummies are still legal.

Delta-8 vapes face a second problem. Senate Bill 2024 has banned selling any e-cigarette product that contains a cannabinoid since September 1, 2025, so a delta-8 pen cannot be sold legally even apart from the July 2026 change. Our guide on whether vapes are banned in Texas covers the rest of that law.

Is delta 8 still legal in Texas anywhere?

Only in trace form. DSHS allows the tiny amounts of delta-8 that the hemp plant itself produces. Almost all delta-8 sold in stores is made by converting CBD in a lab, which is the kind the 2026 change targets.

Delta-9 is different. Hemp products at or under 0.3% delta-9 THC by dry weight remain legal for adults 21 and older, including gummies, drinks and tinctures. Our Texas THC ban guide sorts out every product type, and our THCA guide covers flower.

Real situations: what the delta-8 ban means in practice

You bought delta-8 gummies in June and still have them

The ban applies to possession as of July 31, and a purchase date does not protect you. Austin police said packaging will not make a product labeled delta-8 legal. The safer move is to stop using them and ask a Texas criminal defense attorney before you try to return or dispose of anything.

You own a smoke shop with delta-8 on the shelf

DSHS can detain products labeled delta-8 or shown to hold more than trace amounts, and refer the case to police. Check each product label and lab report, and speak with a Texas attorney who handles hemp licensing before you decide what to do with stock.

You are stopped with a delta-9 gummy that has a lab report

A legal hemp delta-9 product that stays at or under 0.3% is still legal for an adult 21 or older. Keep it in the original package with the label and lab report, which is what Austin police advised. Expect questions, since officers cannot tell products apart by sight.

Myths vs. facts about delta 8 in Texas

MythFact

“Abbott signed a delta-8 ban.”The change came from a Texas Supreme Court ruling and a DSHS rule, not a new law.
“Delta-8 is only banned for sellers.”Possession can be charged too. Austin police said they will treat it as a state jail felony.
“All THC is banned in Texas.”Hemp delta-9 at or under 0.3% is still legal for adults 21 and older.

What could change for delta 8 in Texas

Several things could shift the rules. Press reports say the lawsuit behind the Texas Supreme Court ruling can still continue, so the state’s rule may face more challenges. The Legislature meets in January 2027 and can pass its own hemp rules. Our legalization timeline tracks that session.

Federal law is also moving. Congress narrowed the federal hemp definition in November 2025, and cannabinoids the plant cannot make naturally lose federal hemp status on November 12, 2026. Public Law 119-103, signed in September 2026, delayed parts of the new definition to December 11, 2026, including limits on finished hemp products. Federal hemp status does not override Texas law, so a federal change would not make delta-8 legal here.

What to do if you are affected

Do not consent to a search, and do not discuss where you bought a product. Keep any lab report or label. If you are charged, speak with a Texas-licensed criminal defense attorney before your first court date. Hemp business owners should contact DSHS about license status and ask a Texas attorney about their stock.

Frequently asked questions

Is delta 8 illegal in Texas?

Yes. Since July 31, 2026, delta-8 THC is treated as a controlled substance in Texas, except for trace amounts a hemp plant makes naturally. Sellers risk losing their licenses and facing criminal charges, and Austin police say they will treat possession as a state jail felony.

Is delta 8 still legal in Texas?

No. The old court order that kept the rule on hold was reversed by the Texas Supreme Court on May 1, 2026, and DSHS began enforcing the rule on July 31. Only trace amounts that occur naturally in hemp are exempt, which excludes the delta-8 sold in gummies and vapes.

Is delta 8 banned in Texas?

Yes, in practice. Texas did not pass a new delta-8 law. DSHS reinstated a 2021 rule after a Texas Supreme Court ruling, which makes manufactured delta-8 a controlled substance. Delta-9 hemp products at or under 0.3% delta-9 THC remain legal for adults 21 and older.

Is delta 10 legal in Texas?

No, most likely. The DSHS rule covers THC forms other than delta-9, and reports on the July 31 change say delta-10 and THCP are included, though the rule text does not name them. HHC and THC-O are not named in the sources we reviewed, so their status is unsettled. Treat them as high risk until the state or a court says otherwise.

Are delta 8 gummies legal in Texas?

No. Delta-8 gummies are covered by the same controlled substance rule, whatever the label says about hemp. Hemp delta-9 gummies that stay at or under 0.3% delta-9 THC by dry weight are still legal for adults 21 and older.

Are delta 8 vapes legal in Texas?

No. Delta-8 vapes are covered by the controlled substance rule, and Senate Bill 2024 has also banned selling any cannabinoid vape since September 1, 2025. A person who sells one faces a Class A misdemeanor under Health and Safety Code § 161.0876.

Will Texas allow delta 8 again?

It is possible but not likely soon. The lawsuit that led to the ruling may still continue, and the Legislature meets in January 2027. A federal hemp change does not make delta-8 legal under Texas law. Check the date on this page for the latest update.
