Is CBD Legal in Texas? Oil, Flower, Age 21 Rule and 2026 Changes
Short answer
Yes. CBD made from hemp with no more than 0.3% delta-9 THC by dry weight is legal in Texas under Health and Safety Code ch. 443. Adults 21 and older can buy it from a state-registered seller. Marijuana-based CBD and products with delta-8 or other added THC are not legal.

So, is CBD legal in Texas? For most people buying ordinary hemp CBD, yes. Texas legalized hemp and its CBD products in 2019, and the rules have only tightened around them since, mostly on age limits, labels, THC testing and who may sell. The answer changes when the product is smokable flower, contains extra THC, or comes from marijuana instead of hemp.
This page covers CBD oil, flower, gummies, pens, drinks and creams, the age 21 rule, what the 2026 state rules changed, and the federal deadline that could reshape the market on December 11, 2026.
| CBD oil, tinctures and capsules | Legal if made from hemp at 0.3% delta-9 THC or less, sold to adults 21+ |
|---|---|
| CBD gummies and drinks | Legal under the same limits; sold by a DSHS-registered retailer |
| CBD flower | Narrow in practice: DSHS counts THCA toward total THC, so most hemp flower now fails |
| CBD creams and lotions | Covered by the hemp rules as topical cosmetics; check the label and lab report |
| CBD with delta-8 or marijuana-derived | Not legal hemp; treated as a controlled substance |
| Main laws and rules | Health and Safety Code ch. 443, 25 Texas Administrative Code ch. 300, Agriculture Code ch. 121 |
| Next federal date | December 11, 2026: a lower federal THC cap for finished hemp products (Public Law 119-103) |
Is CBD legal in Texas in 2026?
Yes. Hemp CBD is still lawful to buy, own and use in Texas in 2026. House Bill 1325, signed in 2019, took hemp out of the Texas marijuana definition and told the Department of State Health Services (DSHS) to license makers and register retailers of CBD products. Texas defines a consumable hemp product as any product made for consumption that contains hemp, including food, drugs, devices and cosmetics, and it caps those products at 0.3% delta-9 THC.
What changed is the fine print. Since October 2025 you must be 21 to buy, and since March 31, 2026 DSHS tests finished products for total THC, not just delta-9. A CBD bottle is legal only when the seller is registered, the label is complete and the lab report backs up the THC claim.
Is CBD oil legal in Texas?
Yes. DSHS names CBD oil as a consumable hemp product, and tinctures, capsules and softgels follow the same rules. The oil must come from hemp, stay at or under 0.3% delta-9 THC, and be sold by a registered retailer or a DSHS-licensed maker. Full-spectrum oils usually carry trace THC, which is allowed up to that cap. Broad-spectrum and isolate products usually carry none.
The seller must tell you where the oil came from. Under the DSHS labeling rules, a legal product shows:
- A lot number and the lot date
- The product name and the manufacturer name, phone and email
- A web address or QR code that leads to a Certificate of Analysis
- A statement that delta-9 THC is not more than 0.3 percent
Packages must also be tamper evident and child resistant under 25 Texas Administrative Code § 300.405. A bottle with no lab link is a red flag.
Is CBD flower legal in Texas?
Partly, and the rules have narrowed. Texas has long barred making smokable hemp products in the state: Health and Safety Code § 443.204(4) says DSHS rules must prohibit it. Sales of out-of-state smokable hemp were still tolerated while DSHS wrote new rules. Those rules took effect March 31, 2026 and count THCA toward total THC at about 88%. Most smokable hemp flower carries enough THCA to fail that test, even when it is sold as CBD flower.
So a true low-THC CBD flower that tests at or under 0.3% total THC can still be sold, but much of what shops called CBD flower in past years no longer qualifies. The rules are still being fought in court, and enforcement has shifted, so ask for the lab report before you buy. Our guide on the THCA ban in Texas explains the total THC rule in detail.
Is CBD banned in Texas?
No. Senate Bill 3, a 2025 bill that would have banned consumable hemp products, was vetoed by Governor Abbott in June 2025. Texas chose to regulate hemp instead. What people often call the Texas CBD ban is really a set of limits on THC, age and smokable flower. Plain CBD oil, gummies and creams from licensed sources are not banned.
The ban that did happen targets other cannabinoids. DSHS reinstated its definitions of tetrahydrocannabinols, and since July 31, 2026 delta-8, delta-10, THCP and other non-delta-9 THC forms are enforced as controlled substances in Texas, with only trace natural amounts allowed in hemp. If a CBD gummy or pen also contains those, it is no longer a legal hemp product. See our guide on whether delta 8 is legal in Texas for the details.
Is CBD still legal in Texas after the 2026 changes?
Yes. Here is what the 2025 and 2026 rule changes mean for a CBD shopper:
- Age 21: DSHS emergency rules adopted October 2, 2025 bar sales to anyone under 21 and require a valid government-issued photo ID.
- Total THC testing: since March 31, 2026, THCA counts toward the 0.3% limit.
- Higher license fees: DSHS lists $10,000 a year per facility for a manufacturing license and $5,000 a year per location for a retail registration, plus a Texas Online fee.
- Delta-8 and similar forms: enforced as controlled substances since July 31, 2026.
If you only use isolate or broad-spectrum CBD, these changes mostly affect how you buy, not whether you can. Our Texas THC ban guide lists every hemp rule in one place.
CBD pens, vapes, gummies, drinks and creams
Are CBD gummies and drinks legal?
Yes, under the same limits as oil. DSHS lists CBD gummy bears and CBD-infused food and drinks as consumable hemp products. Our guide on whether edibles are legal in Texas covers the THC gummy and drink side, including the TABC rule for alcohol permit holders.
Are CBD vape pens legal?
No, not safely. Texas banned selling e-cigarette and vape products that contain any cannabinoid, which includes CBD, effective September 1, 2025 under Senate Bill 2024 and Health and Safety Code § 161.0876. A seller faces a Class A misdemeanor, so a CBD vape pen is not a safe legal buy even with no THC. Our guide on whether vapes are banned in Texas explains the law.
Are CBD creams and lotions legal?
Yes. DSHS includes topical lotions and cosmetics that contain CBD in its examples of consumable hemp products, so the same 0.3% delta-9 THC cap and labeling rules apply. Someone who makes or relabels a CBD cream needs a DSHS license. A shop that resells it unchanged needs a retail registration.
Is CBD for pets legal?
Unclear. DSHS says its hemp rules cover animal drugs and devices but not animal food, and DSHS does not say how it treats every pet CBD product. Ask the seller whether the product is registered and tested.
Who can sell CBD in Texas?
Anyone who makes, packages, repackages or relabels hemp products, including white-label brands, needs a DSHS manufacturing license. A seller that resells products without changing them, even online, needs a Retail Hemp Registration for each store address.
Gas stations, grocery stores, pharmacies and vape shops all fall under the same rule. If a store cannot show a registration, you can look up compliance actions on the DSHS Consumable Hemp Program page.
Penalties and who is at risk
| Situation | What can happen | Notes |
|---|---|---|
| Adult 21+ buys hemp CBD within 0.3% delta-9 THC | Legal | Keep the receipt and lab report |
| Seller sells CBD to someone under 21 | DSHS can revoke the license or registration | The rule targets the seller |
| CBD product contains delta-8 or other added THC forms | Treated as a controlled substance | See our delta-8 guide |
| CBD made from marijuana, or product over the THC limit | Can be charged as marijuana | See is weed legal in Texas for penalty ranges |
| Driving after using a product that impairs you | DWI under Penal Code § 49.04 | Legal does not mean safe to drive |
Real situations with CBD in Texas
You buy CBD oil at a gas station
Look for the lot number, the manufacturer contact and a lab report link. Pick a bottle with all three. If a clerk sells CBD to a 19-year-old, the clerk and store are the ones breaking the DSHS rule.
You order CBD gummies from another state
Out-of-state products sold in Texas must meet Texas packaging, labeling and testing rules and be sold by a registered retailer. Check for a Certificate of Analysis showing delta-9 THC at or under 0.3% and no delta-8.
You use CBD and have a workplace drug test
Full-spectrum CBD contains trace THC, so it can raise questions with an employer that tests for it. Ask the employer about its policy and choose isolate if the job requires it. Texas hemp law does not protect you from a workplace policy.

What could change for CBD
The federal hemp definition is the big one. Congress narrowed it in the November 2025 agriculture funding law (Public Law 119-37) so that finished products with more than 0.4 milligrams combined total of THC and similar cannabinoids per container no longer count as hemp. H.R. 6500, now Public Law 119-103, moved most of that change from November 12 to December 11, 2026. The part on cannabinoids the plant cannot make naturally still starts November 12, 2026. A full-spectrum CBD bottle with trace THC can exceed that cap, while isolate and well-tested broad-spectrum products may not. Congress has delayed it once and could act again.
The State’s appeal of the order that had blocked the March DSHS rules is pending before the Fifteenth Court of Appeals, with no confirmed argument date. The Legislature meets in January 2027. Our cannabis, THC and substances guides track each step.
Frequently asked questions
Is CBD legal in Texas?
Yes. CBD from hemp with no more than 0.3% delta-9 THC by dry weight is legal for adults 21 and older to buy and use. It must come from a DSHS-licensed maker or a registered retailer and carry the required label and lab report.
Is CBD oil legal in Texas without a prescription?
Yes. Hemp CBD oil does not need a prescription or a medical card. DSHS names CBD oil as a consumable hemp product. You must be 21 or older, and the seller must check your ID and hold a retail registration.
Is CBD flower legal in Texas?
Only if it tests at or under 0.3% total THC, counting THCA, since March 31, 2026. Much hemp flower fails that test. Texas also bars making smokable hemp products inside the state, so any flower on sale is made elsewhere and must be tested to Texas standards.
Is CBD banned in Texas?
No. The governor vetoed Senate Bill 3 in June 2025, so there is no statewide CBD ban. Texas limits THC, requires registration and sets the age at 21. Products with delta-8 or other non-delta-9 THC forms are the ones Texas now treats as controlled substances.
Do you have to be 21 to buy CBD in Texas?
Yes. DSHS rules adopted on October 2, 2025 bar licensed sellers from selling consumable hemp products to anyone under 21 and require a valid government-issued photo ID. The rule applies to CBD oil, gummies, drinks and creams alike.
Will the federal hemp change make CBD illegal in Texas?
Not by itself. Starting December 11, 2026, finished hemp products with more than 0.4 milligrams combined total of THC and similar cannabinoids per container stop qualifying as federal hemp. Texas law still sets its own rules, but sellers may stop carrying full-spectrum products, and Congress may delay the date.
