Are Edibles Legal in Texas? THC Gummies, Drinks and CBD in 2026

Short answer

Partly. Edibles made from hemp with no more than 0.3% delta-9 THC by dry weight are legal in Texas for adults 21 and older under Health and Safety Code ch. 443. Marijuana edibles and delta-8 gummies are not legal, because Texas treats them as controlled substances under Health and Safety Code ch. 481.

Last verified October 30, 2026 against current Texas law

So, are edibles legal in Texas? It depends on what is inside them. A gummy, chocolate or drink made from licensed hemp is a legal product for adults. The same gummy made from marijuana, or from delta-8, can lead to a felony charge. The package often looks identical, which is why so many people get this wrong.

This page sorts out which edibles are legal, the age and label rules, what happens to marijuana and delta-8 gummies, and what could change before the end of 2026.

Are THC gummies legal in Texas?

Yes, if they are hemp-derived delta-9 gummies and you are 21 or older. The product must stay at or under 0.3% delta-9 THC by dry weight, and the seller must hold a license or registration from the Department of State Health Services (DSHS). That is the same rule our Texas THC ban guide explains for all hemp products.

No, if the gummy contains delta-8, another non-delta-9 THC form such as delta-10 or THCP, or marijuana. DSHS does not allow more than trace natural amounts of those forms in hemp, so they are not legal hemp edibles in Texas. Our guide on whether delta 8 is legal in Texas explains the 2026 change. A label that says “hemp-derived” does not change that.

Texas has no statewide per-gummy milligram cap in the DSHS rules we reviewed. The 0.3% limit is measured by dry weight, which is why lab reports matter more than the number printed on the front of the bag.

Are weed gummies legal in Texas?

No. A gummy or brownie made with marijuana is not hemp, and Texas does not allow it outside the Compassionate Use Program. Buying one legally in Colorado or New Mexico does not make it legal to bring home.

Prosecutors can charge a marijuana-infused edible as a Penalty Group 2 substance under Health and Safety Code § 481.116, which starts as a state jail felony for less than a gram. The weight can include the sugar and gelatin around the THC. Our guide on whether weed is legal in Texas shows how that weight ladder works. A bag of flower under 2 ounces is a misdemeanor, but an edible can be charged much higher.

Are edibles illegal in Texas for anyone under 21?

Yes, for buying. Under DSHS rules, licensed sellers cannot sell consumable hemp products to anyone under 21 and must check a valid government-issued ID before the sale. A seller who sells to a minor can lose its license or registration.

The age rule applies to hemp edibles of every kind, including CBD gummies and hemp drinks (see our guide on whether CBD is legal in Texas). Governor Abbott began the 21 limit with Executive Order GA-56 in September 2025, and DSHS adopted emergency rules on October 2, 2025.

Are CBD gummies legal in Texas?

Yes. CBD gummies made from hemp are legal consumable hemp products in Texas, and DSHS lists CBD gummy bears and CBD-infused foods and drinks as examples. They must still stay under 0.3% delta-9 THC by dry weight and be sold by a licensed manufacturer or a registered retailer.

Since October 2025 you also have to be 21 or older to buy them. A CBD gummy that contains delta-8 or other added THC forms falls into the illegal category described above.

Are THC drinks legal in Texas?

Yes, if the drink uses hemp delta-9 THC within the 0.3% limit and the buyer is 21 or older. DSHS treats hemp-infused food and drinks as consumable hemp products.

Alcohol permit holders have extra rules from the Texas Alcoholic Beverage Commission (TABC). Under 16 Texas Administrative Code § 35.7, effective June 22, 2026, a license or permit holder cannot allow anyone to consume a consumable hemp product on premises where drinking alcohol is generally prohibited, such as package stores and other off-premise retailers. TABC also requires an ID check and bars sales to anyone under 21. A TABC permit does not by itself allow hemp sales, because each selling location needs its own DSHS registration.

Are THC drinks still legal in Texas? For now, yes under state law. The risk is federal. Congress narrowed the federal hemp definition in November 2025, and finished products with more than 0.4 milligrams of total THC per container stop counting as hemp. H.R. 6500, now Public Law 119-103, moved most of that change from November 12 to December 11, 2026. A drink or gummy with 5 milligrams of THC is far over that line.

Are THC drinks banned in Texas? No state law bans them. Bills for a longer delay or a repeal are pending, and none has passed. The November 12, 2026 date still applies to synthetic cannabinoids that the plant cannot make naturally.

Are mushroom and other novelty edibles legal in Texas?

The hemp rules cover hemp only. A gummy sold as a “mushroom” product is not a hemp product, and psilocybin remains a controlled substance in Texas. We did not find an official Texas statement clearing other mushroom-derived gummies, so treat them as unsettled.

What the rules require on a legal hemp edible

A legal edible should show you where it came from and what is in it. The DSHS rules in 25 Texas Administrative Code ch. 300 require labeling and a Certificate of Analysis from an accredited lab, often reached by a QR code. Products must be in tamper-evident, child-resistant packaging, and multi-serving packages must reseal in a child-resistant way.

  • Lot number and manufacturer: the label should name the maker and give contact information.
  • Lab report: a scannable code or web address should lead to a current Certificate of Analysis showing delta-9 THC at or under 0.3%.
  • Seller license: hemp sellers must hold a DSHS license (manufacturers) or registration (retailers). DSHS posts compliance actions on its website.
  • Total THC: since March 31, 2026, DSHS counts THCA when testing finished products, using the total THC formula (0.877 times THCA plus THC) in 25 Texas Administrative Code § 300.101.

Penalties for edibles in Texas

Penalties depend on the product and your role. Buyers face criminal charges only when the edible itself is illegal. Sellers face license action first.

Real situations with Texas edibles

You buy gummies at a Texas smoke shop

Check the label for delta-9 and scan the lab report. If the package says delta-8, HHC or “THC-O,” or has no lab report at all, put it back. Austin police say a delta-8 label can give them probable cause, though officers may instead seize the product and release the person.

You carry dispensary gummies home from New Mexico

They are marijuana products under Texas law, even though they were legal where you bought them. Carrying them across the border is also a federal crime.

You are 20 and a store sells you a gummy

The store broke the DSHS rule, and it risks losing its license. The rule is aimed at the seller, so ask the store for its DSHS license number if you want to report it.

You take an edible and drive

A legal product does not protect you on the road. Driving while intoxicated by any substance is DWI under Penal Code § 49.04. Edibles can hit hours after you eat them, so see our driving and vehicle guides.

What could change for edibles

Two things could shift the picture soon. The federal cap on finished hemp products takes effect December 11, 2026, and Congress could still delay or repeal it. The Fifteenth Court of Appeals hears the state appeal over the March DSHS rules on December 8, 2026 in DSHS v. Texas Hemp Business Council, No. 15-26-00099-CV. The Legislature also meets in January 2027, and hemp is likely on the agenda.

Frequently asked questions

Are edibles legal in Texas?

Are THC gummies legal in Texas?

Yes, if they are hemp-derived delta-9 gummies sold by a DSHS-licensed or registered seller to an adult 21 or older. Gummies made with delta-8 or marijuana are not legal, and DSHS treats other non-delta-9 THC forms the same way. A lab report should show delta-9 THC at or under 0.3%.

Are CBD gummies legal in Texas?

Yes. CBD gummies made from hemp are legal consumable hemp products. They must stay within the 0.3% delta-9 THC limit, come from a licensed source and be sold only to adults 21 and older under the DSHS rules adopted in October 2025.

Are THC drinks still legal in Texas?

Yes, under state law, if the drink uses hemp delta-9 THC within the limit and the buyer is 21 or older. The risk is federal: a stricter federal hemp definition starts December 11, 2026, and it could make most THC drinks unlawful under federal law.

Are edibles illegal in Texas if they have marijuana in them?

Yes. A marijuana-infused gummy, brownie or candy is not hemp. Prosecutors can charge it as a Penalty Group 2 substance under Health and Safety Code § 481.116, which is a felony at any amount, starting as a state jail felony under one gram, even if it was bought legally in another state.

Are weed gummies legal in Texas?

No. Gummies with marijuana are illegal in Texas unless a Compassionate Use Program patient receives them from a licensed dispensing organization. Other states’ medical cards do not apply here.
