What is the legal age to buy cigarettes in Texas?

It is 21. Texas bars selling or giving cigarettes, e-cigarettes and other tobacco products to anyone under 21, and Senate Bill 21 raised the age from 18 on September 1, 2019. Congress set the same minimum of 21 nationwide on December 20, 2019, so the age does not drop when you cross into another state.

Vapes count. E-cigarettes fall under the same age-21 rule, and retailers that sell them need an e-cigarette permit from the Texas Comptroller. Senate Bill 248 created that permit effective September 1, 2021, and it became mandatory on January 1, 2022. Since September 1, 2025, Senate Bill 2024 also makes it a Class A misdemeanor to market or sell certain e-cigarette products, including vapes that contain cannabinoids, look like toys or school supplies, or are made in China or another country the U.S. treats as a foreign adversary. Hemp-derived THC products such as gummies and drinks are also sold only to adults 21 and older, as we explain in our Texas THC ban guide.

Texas allows one exception to the sales ban. A buyer who is at least 18 and shows a valid U.S. or state military identification card at the time of purchase is not covered. Federal law sets the minimum at 21 with no military exception, so a store can still face federal penalties for that sale.

A parent cannot make it legal. The 2019 law removed the old exception that let a minor possess tobacco in front of a parent, guardian or spouse. Sellers do have a defense if the buyer showed apparently valid government-issued photo ID stating the holder is 21 or older, such as a Texas driver license, a state ID card or a passport.

Seller or store employeeSelling or giving tobacco to someone under 21 (criminal negligence); § 161.082Class C misdemeanor (fine up to $500); the employee is personally responsible

Buyer under 21 (not a military ID holder aged 18 or older)Possessing, buying, using or accepting tobacco, or showing a fake ID; § 161.252Fine up to $100, a tobacco awareness program or community service; a parent may be ordered to attend

A conviction under 21 is not permanent. The court must tell the person they can apply to have it expunged on or after their 21st birthday, under Health and Safety Code § 161.255.

What is the legal age in Texas for adulthood?

You become a legal adult at 18. Under Civil Practice and Remedies Code § 129.001, that is the age of majority, when you can sign binding contracts and make your own medical decisions without a parent. Turning 18 does not change every age limit, though. Tobacco, vapes and alcohol stay off limits until 21.

What is the legal age to drink in Texas?

It is 21. Under Alcoholic Beverage Code ch. 106, anyone under 21 is a minor for alcohol, and buying, attempting to buy, drinking or possessing it are all offenses. Our Texas alcohol laws guide covers sales hours and adult rules.

Offense countCourt penaltyLicense effect
FirstClass C misdemeanor, plus 8 to 12 hours of community service30-day suspension, or denial if you have no license
SecondClass C misdemeanor, plus 20 to 40 hours of community service60-day suspension
Third or later (17 to 20 years old)Fine of $250 to $2,000, up to 180 days in jail, or both180-day suspension

Two exceptions matter. A minor who drinks or possesses alcohol in the visible presence of an adult parent, guardian or spouse has a defense or exception, but nothing in that rule allows a minor to buy it. A minor who is the first to call for emergency medical help for a possible alcohol overdose is also protected from a charge under §§ 106.04 and 106.05.

What is the legal age to get a tattoo in Texas?

It is 18. Under Health and Safety Code § 146.012, a tattooist may not tattoo anyone younger than 18, and a parent’s signature does not change that. The only exception is covering an existing tattoo that has offensive or gang-related markings, and then a parent or guardian must consent.

A minor who falsely claims to be 18 or shows a document suggesting it commits a Class B misdemeanor. Tattooists also cannot work on someone they suspect is under the influence of alcohol or drugs.

What is the legal working age in Texas?

Texas generally bars employing a child under 14, with exceptions for child performers, work in a parent’s business, certain farm work and newspaper routes. Workers who are 14 or 15 face Texas limits of 8 hours a day and 48 hours a week, no work between 10 p.m. and 5 a.m. before a school day, and no work between midnight and 5 a.m. on other days. The Texas Workforce Commission applies the stricter of state and federal rules.

At 16 and 17, Texas sets no limits on hours, but hazardous jobs such as roofing and operating power-driven woodworking machines remain off limits. See our Texas labor laws guide for pay and child labor rules.

What is the legal age to drive in Texas?

You can get a provisional license at 16 after holding a learner license for at least six months, under Transportation Code § 521.204. You also need a driver education certificate and must pass the exams. A learner license is available at 15.

Drivers under 18 face extra limits. They cannot drive between midnight and 5 a.m. except for work, school activities or emergencies, cannot carry more than one passenger under 21 who is not family, and cannot use a phone at all, even hands-free, except in an emergency. Our driving and vehicles guides cover the rest.

What is the legal age to get married in Texas?

It is 18. Since Senate Bill 1705 took effect on September 1, 2017, a person under 18 can marry only after a court order removing the disabilities of minority for general purposes. Parental consent alone no longer works, and a marriage of a minor without that order is void.

Texas age verification laws for websites and apps

Two Texas laws now require online age checks. House Bill 1181 requires websites where more than one third of the content is harmful to minors to verify that visitors are adults. The U.S. Supreme Court upheld it 6 to 3 on June 27, 2025, in Free Speech Coalition v. Paxton. Our guide to adult content laws in Texas explains what it means for viewers.

Senate Bill 2420 targets app stores. Apple, Google and similar operators must verify each user’s age category and get parental consent before a minor downloads an app or makes an in-app purchase. A federal judge in Austin blocked it on December 23, 2025. The Fifth Circuit paused that order on June 4, 2026, and the U.S. Supreme Court declined to vacate the pause on July 6, 2026. The lawsuit continues, and as far as we could determine the appeal has not been decided, so check the court docket for news.

What age can you legally move out in Texas?

At 18, you can live wherever you choose. Younger teens need a court order. A Texas resident who is 17, or 16 and living apart from parents, can petition for emancipation under Family Code ch. 31, but only if the teen is self-supporting and manages their own finances.

Real situations: how Texas age rules play out

A 19-year-old soldier buys cigarettes

Texas law lets a buyer who is 18 or older show a military ID. Federal law still says 21 for everyone, so a store may refuse, and the store carries the risk if it sells.

A 20-year-old orders wine with a parent at dinner

The parent exception covers the minor drinking in the parent’s visible presence. It does not stop the restaurant from facing a charge for selling to a minor under § 106.03, so most places will not serve the order.

A 17-year-old wants a tattoo with a parent’s signature

Texas studios cannot do it. Unlike some states, Texas has no parental consent route for an ordinary tattoo under 18.
