What Animals Are Illegal to Own in Texas? Exotic Pets, Dog Rules and Penalties

Short answer

Partly. Texas bans few pets outright. Raccoons, skunks and native foxes generally cannot be kept as pets, wolves are barred, and lions, tigers, bears, servals, caracals and apes need a certificate under Health and Safety Code § 822.103. Dogs are legal but regulated, and cruelty is a crime under Penal Code § 42.092.

What animals are illegal to own in Texas? The honest answer is a short list of banned wild animals, a longer list of animals that need a registration certificate, and a set of dog and cruelty rules that apply to every owner. Texas does not ban most common pets, but a cat that is part serval, a dog that bites someone or a dog kept on a chain can all land an owner in trouble. This page sorts the rules by animal, using the Texas Health and Safety Code, the Penal Code and the Human Resources Code.

What animals are illegal to own in Texas?

Three groups matter. The first is wildlife that generally cannot be kept as a pet, including raccoons, skunks and native foxes. The second is “dangerous wild animals,” which an owner may keep only after registering them with local animal control. The third is everything else, which state law does not ban but a city, county, landlord or homeowners association may.

“Not named in state law” does not mean “approved.” City ordinances, zoning and lease terms can ban animals the state allows, so call animal control before you buy.

Are Savannah cats and servals legal in Texas?

A serval is on the dangerous wild animal list, so owning one requires a certificate of registration from the local animal registration agency. The list in Health and Safety Code § 822.101 also covers “any hybrid” of a listed animal, and a Savannah cat is a serval-domestic cat cross. The statute does not say how many generations removed from a serval a cat stays a hybrid, and we found no court ruling or agency rule that settles it, so an early-generation Savannah may be covered and a later-generation cat is an open question. Ask your local animal control in writing how it classifies the cat before you buy.

Dangerous wild animal rules and penalties

Anyone who owns or has custody of a listed animal must hold a certificate of registration, which cannot be transferred, lasts one year and requires at least $100,000 in liability insurance per occurrence. Owning one without a certificate is a Class C misdemeanor under Health and Safety Code § 822.113, which carries a maximum fine of $500, and each animal and each day counts as a separate offense. Knowingly selling or transferring one to a person without a certificate is also a Class C misdemeanor. Our raccoon guide walks through the exemptions, the display rule and the escape reporting duty.

Texas dog laws: what every owner must follow

Dogs are legal, but three sets of rules can reach an owner: the dangerous dog law, the restraint law and the cruelty law.

Texas dog bite and dangerous dog law

A dog is “dangerous” under Health and Safety Code § 822.041 if it makes an unprovoked attack on a person that causes bodily injury outside an enclosure, or commits unprovoked acts that make a person reasonably believe it will attack. Within 30 days of learning the dog is dangerous, the owner must register it with animal control, keep it on a leash in a person’s immediate control or in a secure enclosure, and carry at least $100,000 in liability insurance or show financial responsibility under § 822.042.

After an investigation, animal control may declare a dog dangerous, and the owner has until the 15th day after notice to appeal to a justice, county or municipal court under § 822.0421. If an owner is found guilty of the attack offense in § 822.005, the court may order the dog destroyed under § 822.005(c), and a non-compliant owner can lose the dog after a seizure under § 822.042.

Is it illegal to chain a dog in Texas?

Yes, in the way most people mean it. Health and Safety Code § 821.102, part of the Texas Safe Outdoor Dogs Act that took effect January 18, 2022, bars leaving a dog outside and unattended on a chain or on a restraint with weights attached. A restraint must be at least five times the dog’s length or 10 feet, whichever is greater, and the collar or harness must be properly fitted.

An owner who leaves a dog restrained outside must also give it adequate shelter, shade, potable water and a spot free of standing water and excessive waste. A knowing violation is a Class C misdemeanor, or Class B after a prior conviction, and each dog is a separate offense. Exceptions in § 821.103 cover hunting, herding, licensed activities, public camping areas and a short, temporary task with a dog in an open truck bed, and walking a dog on a handheld leash is not prohibited.

Texas leash law

The state dog statutes above require a leash or secure enclosure for dogs declared dangerous, and we found no general state leash law for other dogs. Everyday leash rules usually come from city and county ordinances, so a dog that is legal off-leash in one county may be a citation in the next. Check your city code or call animal control.

Texas animal cruelty laws

Penal Code § 42.092 covers dogs, cats and other nonlivestock animals. Failing unreasonably to provide necessary food, water, care or shelter, abandoning an animal, or transporting or confining an animal in a cruel manner is a Class A misdemeanor, and it becomes a state jail felony after repeat convictions. Torturing or cruelly killing an animal is a third-degree felony, and killing one without the owner’s consent is too.

Is it illegal to leave a dog in a car in Texas? The statute does not mention cars, but confining an animal in a cruel manner or failing to give it necessary care can cover a dog left in a hot vehicle, depending on the facts. If you see a dog in distress, call 911 or local animal control instead of breaking a window.

Service animals and emotional support animals

Human Resources Code § 121.006 makes it an offense to intentionally or knowingly represent that an animal is an assistance or service animal when it is not specially trained or equipped to help a person with a disability. The penalty is a misdemeanor with a fine of up to $1,000 and 30 hours of community service. A vest or an online registration does not change that. Rules for housing and for each store or restaurant are separate questions, so ask the business or your landlord for its written policy.

Real situations: what the law means for you

Your neighbor’s dog bites you on a public sidewalk

Report the bite to animal control and get medical care. Animal control can investigate under § 822.0421 and may declare the dog dangerous, which triggers registration, leash and insurance duties for the owner. A civil claim for your medical bills is a separate matter to discuss with a Texas-licensed personal injury attorney.

You are buying a Savannah cat or a serval

Get the breeder’s documentation of the cat’s generation, then ask your local animal registration agency in writing whether the cat needs a certificate. Do not rely on the seller’s word, because a seller who knowingly transfers a dangerous wild animal to a buyer without a certificate commits an offense.

Your dog lives on a chain in the backyard

Replace the chain with a properly fitted harness and a restraint of at least 10 feet, or better, a fenced area. Make sure shelter, shade and clean water are always available, since a violation is a separate offense for each dog.

Myths vs. facts about animal laws in Texas

MythFact
“Texas allows any exotic pet.”Raccoons, skunks and native foxes generally cannot be kept, wolves are barred, and big cats, bears and apes need a certificate.
“A Savannah cat is just a house cat.”The dangerous wild animal law covers hybrids of listed animals, a serval is a listed animal, and a Savannah may be treated as a hybrid.
“Chaining a dog is fine if it has water.”A chain is barred outright for an unattended dog under Health and Safety Code § 821.102(b)(1).
“A service animal vest makes any pet a service animal.”Falsely claiming an untrained animal is a service animal is a misdemeanor.

What to do if you are cited or your animal is seized

Do not release the animal. Ask the agency for the exact statute and hearing date, and note the 15-day appeal window for a dangerous dog finding. Contact TPWD for wildlife questions and your city animal control for local rules, and speak with a Texas-licensed criminal defense attorney before your court date.

Are servals legal in Texas?

Yes, with a certificate. A serval is a listed dangerous wild animal under Health and Safety Code § 822.101, so the owner must register it with the local animal registration agency, carry $100,000 in liability insurance and follow any stricter city or county ordinance.

What happens if my dog bites someone in Texas?

Animal control can investigate and may declare the dog dangerous, which requires registration, a leash or secure enclosure and $100,000 in insurance. If an unsecured dog causes serious bodily injury, the owner can face a third-degree felony, and a court may order the dog destroyed.

Is it illegal to leave a dog in the car in Texas?

No statute names cars, but Penal Code § 42.092 makes it a Class A misdemeanor to confine an animal in a cruel manner or fail to provide necessary care. A dog left in a hot vehicle can fall under it depending on the facts.
