Is Gambling Legal in Texas? Casinos, Slots, Lottery and Penalties
Short answer
Partly. Most gambling is illegal in Texas, including commercial casinos, slot machines and sports betting. Betting is a Class C misdemeanor under Penal Code § 47.02, and running gambling is a Class A misdemeanor. Exceptions include the state lottery, horse racing, charitable bingo and raffles, and three tribal casinos that offer electronic bingo.

Is gambling legal in Texas? For the most part, no. The state has no Las Vegas style casinos, no licensed slot machines and no licensed sportsbooks. What Texas does allow is a short list of exceptions that voters approved one at a time through constitutional amendments. This guide explains what the Penal Code bans, which kinds of gambling are allowed, how the three tribal casinos fit in, what the penalties are, and what could change when lawmakers meet in January 2027.
| Commercial casinos | Illegal. No state license exists. |
|---|---|
| Slot machines | Illegal as gambling devices, with a narrow exception for amusement games with tiny prizes |
| Sports betting | Illegal. See our sports betting guide. |
| Legal wagering | State lottery, pari-mutuel horse racing, charitable bingo and raffles |
| Tribal casinos | Three, limited to Class II games such as electronic bingo |
| Main laws | Penal Code ch. 47, Texas Constitution art. III, § 47, Government Code ch. 466 |
| Next chance to change | Regular session begins January 12, 2027 |
Is gambling legal in Texas?
No, unless a specific law carves out an exception. Under Penal Code § 47.01, a bet is an agreement to win or lose something of value solely or partly by chance. The Penal Code makes betting a crime, and then lists the activities that are not crimes because the Constitution or another statute allows them.
The Texas Constitution sets the rule. Texas Constitution art. III, § 47 requires the Legislature to prohibit lotteries and gift enterprises, except for the ones the Constitution itself authorizes. That is why the Legislature cannot simply pass a casino bill. Each new form of gambling needs a constitutional amendment first.
Is it illegal to gamble in Texas? Penalties by offense
Yes. Gambling as a player is a low-level offense, but running gambling or owning machines is much more serious. Class A and Class C limits come from Penal Code §§ 12.21 and 12.23.
| Conduct | Law | Offense | Maximum penalty |
|---|---|---|---|
| Betting on a game, an election, or playing a gambling device or card or dice game for money | Penal Code § 47.02 | Class C misdemeanor | $500 fine |
| Operating or sharing in the earnings of a gambling place, bookmaking, or selling lottery chances or tickets | Penal Code § 47.03 | Class A misdemeanor | 1 year in jail, $4,000 fine |
| Keeping a gambling place: letting gambling happen on property you own or control, or renting property expecting gambling | Penal Code § 47.04 | Class A misdemeanor | 1 year in jail, $4,000 fine |
| Owning or possessing a gambling device to further gambling | Penal Code § 47.06 | Class A misdemeanor | 1 year in jail, $4,000 fine |
One defense matters to everyday Texans. Under Penal Code § 47.02(b), it is a defense that you gambled in a private place, nobody received an economic benefit other than personal winnings, and everyone had the same risk of losing and chance of winning. A home poker night where the host takes no cut can fit. A game where the host keeps a fee, or one held in a public place, does not.
What kinds of gambling are legal in Texas?
Four main forms are authorized, and each has its own regulator and rules. Parks and Wildlife drawings and certain sports team charity raffles are also allowed under Penal Code § 47.02(c).
- The Texas Lottery: Authorized by voters in 1991 and run under
Government Code ch. 466. Buyers must be 18 or older. - Pari-mutuel horse racing: The Texas Racing Commission licenses tracks, including Sam Houston Race Park, Lone Star Park and Retama Park. Betting is limited to licensed racing, not other sports.
- Charitable bingo: Authorized by a 1980 amendment and limited to licensed nonprofits. Since September 1, 2025, the Texas Department of Licensing and Regulation (TDLR) regulates it.
- Charitable raffles: Licensed nonprofits can hold raffles under
Occupations Code ch. 2002.
The 2025 lottery overhaul
Senate Bill 3070, signed in June 2025, abolished the Texas Lottery Commission. TDLR took over the lottery on September 1, 2025. The law also banned online ticket sales and lottery courier services, and a violation is a Class A misdemeanor. Jackpocket suspended its Texas service in February 2025 when the Lottery Commission moved against couriers, and SB 3070 later made the ban law. The lottery continues until 2029, when lawmakers must extend it after a Sunset Advisory Commission review.
Are casinos legal in Texas?
Commercial casinos are not legal, but three tribal casinos operate. The Kickapoo Traditional Tribe runs Lucky Eagle Casino in Eagle Pass, the Alabama-Coushatta Tribe runs Naskila Casino near Livingston, and the Ysleta del Sur Pueblo runs Speaking Rock in El Paso.
These casinos are limited to Class II gaming, which means electronic bingo and similar games. Class III games, such as true slot machines, blackjack and roulette, require a compact between the tribe and the state, and Texas has not signed one. In June 2022, the U.S. Supreme Court held in Ysleta del Sur Pueblo v. Texas that the federal Restoration Act bans on tribal land only gaming that Texas bans outright, and that Texas lacks regulatory authority over the rest. That decision lets the Pueblo and the Alabama-Coushatta keep offering bingo-style games. It did not authorize Class III games.
Are casinos illegal in Texas outside tribal land?
Yes. A casino operating anywhere else in Texas would involve a gambling place, gambling devices and bets, so the owner risks charges under Penal Code §§ 47.03, 47.04 and 47.06. No city can license a casino on its own.
Are slot machines legal in Texas?
Generally no. A gambling device under Penal Code § 47.01(4) is a machine that, for a fee, gives the player a chance to win something of value determined partly or wholly by chance, even if some skill is involved. Possessing one to further gambling is a Class A misdemeanor under Penal Code § 47.06.
The law has one narrow exception. Machines made and adapted solely for bona fide amusement are not gambling devices if they pay only noncash prizes, toys or novelties, and the wholesale value of a prize from a single play is no more than 10 times the cost of the play or $5, whichever is less. Arcade claw machines fit this exception. Machines that pay cash or cash-like credits do not. Game room machines often called eight-liners and newer skill-game machines are in active litigation, and a 2022 Fort Worth appeals court decision held eight-liners illegal. Lawmakers are expected to take up the issue in 2027.
Why is gambling illegal in Texas?
It is illegal because of a long constitutional and criminal law history that treats gambling as something the state must restrict unless voters decide otherwise. The framers of the 1876 Constitution were wary of how gambling affects poorer residents, and they did not trust the Legislature to regulate it.
| Year | Event |
|---|---|
| 1845 | The first state constitution bans selling lottery tickets and a state-run lottery |
| 1876 | Article III, Section 47 requires laws against lotteries and gift enterprises |
| 1879 | The Penal Code makes betting money in public places on games or contests a crime |
| 1980 | Voters allow charitable bingo, subject to local approval |
| 1991 | Voters approve a state lottery |
| June 2022 | The U.S. Supreme Court decides Ysleta del Sur Pueblo v. Texas |
| June 2025 | SB 3070 abolishes the Texas Lottery Commission and bans online ticket sales |
| September 1, 2025 | TDLR takes over the lottery and charitable bingo |
What gambling apps are legal in Texas?
No casino or sportsbook app holds a Texas license, because Texas issues none. An app that works on your phone is not automatically legal in the state.
Is bet365 legal in Texas?
No. bet365 runs licensed sportsbooks in states that issue licenses. Texas has no sports betting license for it to hold. The same is true of other sportsbooks. ESPN Bet, which had been a Penn Entertainment brand, ended in late 2025, and ESPN now partners with DraftKings, which also holds no Texas license. Our sports betting guide covers bets, daily fantasy and prediction markets.
Sweepstakes casino sites
Online sweepstakes casinos describe their coins as free to play, and their legal status in Texas is untested. Texas regulates certain mailed sweepstakes under Business and Commerce Code ch. 622, and the attorney general can enforce it, but the chapter does not clearly address these sites. The attorney general could also pursue them under the Deceptive Trade Practices Act or Penal Code ch. 47. We did not find a Texas attorney general lawsuit against an online sweepstakes casino as of this date.
Real situations: what the law means for Texans
You host a Friday poker night at your house
If you take no rake, every player has equal chances apart from skill, and the game is in a private place, the defense in Penal Code § 47.02(b) may apply. If you charge a seat fee or keep part of the pot, you risk a gambling promotion charge under § 47.03, and a charge for keeping a gambling place under § 47.04 if the game is not private.
You own a convenience store and a vendor offers a cash-out machine
Possessing a machine that pays cash or cash-like credits can be charged under Penal Code § 47.06. Letting gambling happen on your property is a separate Class A misdemeanor under § 47.04. The $5 amusement exception does not cover cash-out machines.
You drive from Dallas to Oklahoma for a casino weekend
Gambling at a licensed casino in Oklahoma is legal there, and your Texas residency does not change that. The Texas rules apply to gambling in Texas.

Will Texas legalize casinos?
Not before 2027. A casino amendment needs two-thirds of the House and Senate, followed by a majority vote of Texas voters. In May 2023, a casino amendment (HJR 155) got 92 House votes in a preliminary vote, eight short of the 100 needed, and died. In 2025, Las Vegas Sands lobbied again for destination resorts in large cities, but Senate Republican leaders, including Lt. Gov. Dan Patrick, said the votes were not there, and no casino resolution moved.
The next regular session begins January 12, 2027. Even if lawmakers pass an amendment, voters would decide later, and the Legislature would then have to create a regulator and licensing rules. We track bills in our Texas legal news section.
