Texas THC Ban: What Is Legal and What Is Banned in 2026
Short answer
Partly. Texas has not banned all THC. Hemp products with no more than 0.3% delta-9 THC by dry weight are still legal for adults 21 and older. Since July 31, 2026, delta-8, delta-10 and THCP are controlled substances, and THC vapes cannot be sold under Health and Safety Code § 161.0876.
Last verified October 24, 2026 against current Texas law
The Texas THC ban is not one law. It is a stack of state rules, a governor’s order and court rulings that took effect over about a year, and each one covers a different product. Some THC is still sold in Texas, some became a felony risk on July 31, 2026, and a few questions, like smokable THCA flower, are still being fought in court.
This page sorts out what is legal, what is banned, who can still buy, and what is coming next.
| Delta-9 hemp (gummies, drinks, tinctures) | Legal at 0.3% delta-9 THC or less by dry weight, adults 21+ only |
|---|---|
| Delta-8, delta-10, THCP | Controlled substances in Texas since July 31, 2026 |
| THC vapes and pens | Sale banned since September 1, 2025 (Senate Bill 2024) |
| Smokable hemp and THCA flower | Contested: the total THC rule is enforceable while lawsuits continue |
| Medical THC | Low-THC cannabis through the Compassionate Use Program only |
| Main laws and rules | Health and Safety Code ch. 443, Health and Safety Code § 161.0876, 25 Texas Administrative Code ch. 300, Occupations Code ch. 169 |
Did Texas ban THC?
Not entirely. The Legislature never passed a full THC ban, but regulators and courts have narrowed what can legally be sold. The biggest piece came from a Texas Supreme Court ruling in May 2026, and DSHS began enforcing it on July 31, 2026.
Marijuana itself was never legal here. If you want the rules for flower, see our guide on whether weed is legal in Texas. This page is about hemp-derived THC, the products sold in smoke shops, gas stations and online.
What THC is legal in Texas?
Hemp-derived delta-9 THC is legal in Texas if the product stays at or under 0.3% delta-9 THC by dry weight and the buyer is 21 or older. That covers many gummies, drinks, tinctures and chocolates. CBD products made from hemp also remain legal.
A seller must hold a state license or registration from the Department of State Health Services (DSHS) and must check a government ID. Under the DSHS rules, selling to anyone under 21 can cost a seller its license.
How much THC is legal in Texas?
The legal limit is 0.3% delta-9 THC by dry weight. That is a percentage of the product’s dry weight, not a count of milligrams per gummy.
Since March 31, 2026, DSHS has also counted THCA when it tests finished products. The formula is total THC = (0.877 × THCA) + THC, found in 25 Texas Administrative Code § 300.101. A product that is under 0.3% delta-9 on its own can fail once its THCA is added in.
Are delta-8, delta-10 and THCP legal in Texas?
No. Since July 31, 2026, delta-8, delta-10, THCP and other non-delta-9 THC forms are treated as controlled substances in Texas. DSHS allows only the trace amounts of delta-8 that the hemp plant produces naturally.
The change came from a DSHS rule from 2021 that listed these forms in the state’s controlled substances schedule. A Travis County injunction had blocked it for years. In Texas Department of State Health Services v. Sky Marketing Corp., No. 23-0887, the Texas Supreme Court reversed that injunction on May 1, 2026. DSHS then published a Texas Register notice on July 10 saying the definitions would be enforced starting July 31.
Austin police say they will treat possession of less than 1 gram of delta-8 as a state jail felony. Dallas police said it may be a state jail felony depending on the circumstances, and Houston police said prosecutors decide the charge. A state jail felony carries 180 days to 2 years and a fine up to $10,000 under Penal Code § 12.35.
HHC and other newer cannabinoids are not named in the sources we reviewed, and we found no official Texas statement clearing them. Treat them as unsettled and risky.
Are THC pens and vapes legal in Texas?
No, not to sell. Senate Bill 2024, effective September 1, 2025, makes it a crime to sell or market an e-cigarette product that contains or is mixed with any cannabinoid. The sale is a Class A misdemeanor under Health and Safety Code § 161.0876, which carries up to a year in jail and a $4,000 fine.
The law excludes prescription medication and other prescribed substances, which would cover cannabinoid products prescribed through the Compassionate Use Program. A THC cartridge from a smoke shop, online store or another state is still a product Texas retailers cannot lawfully sell.
Is smokable hemp and THCA flower legal in Texas?
It is contested, and the answer depends on whether you are asking about selling or possessing. For sellers, THCA flower mostly cannot meet the total THC rule, and that rule has been enforceable since June 2026.
The Fifteenth Court of Appeals lifted a trial court’s injunction against the rules on June 5, 2026. A state law, Health and Safety Code § 443.204, also bars making consumable hemp products for smoking.
Whether it is a crime to possess a bag of THCA flower is unsettled. The 2019 hemp law exempts hemp from the controlled substances act, but the July 31 schedule appears to reach THCA. No state official has given a clear answer, and the Department of Public Safety has said courts decide legality. A separate guide on THCA is planned for this site.
Is medical THC legal in Texas?
Yes, for registered patients with a qualifying condition, and only as low-THC cannabis. The Texas Compassionate Use Program is run by the Department of Public Safety under Occupations Code ch. 169.
House Bill 46, signed in June 2025, expanded the program. It added conditions such as chronic pain, traumatic brain injury and Crohn’s disease, and raised the license cap to 15. A doctor registered with the program prescribes it, and licensed dispensing organizations fill the prescription.

What are the penalties?
The penalty depends on the product and on who you are. Sellers face license action and criminal charges, and buyers face charges only when the product itself is illegal.
| Situation | Charge or penalty | Range |
|---|---|---|
| Selling a THC vape | Class A misdemeanor (Health and Safety Code § 161.0876) | Up to 1 year, fine up to $4,000 |
| Possessing under 1 gram of delta-8 (how Austin police say they will charge it) | State jail felony | 180 days to 2 years, fine up to $10,000 |
| Possessing 2 ounces or less of marijuana (cannabis over 0.3% delta-9 THC is marijuana, not hemp) | Class B misdemeanor (Health and Safety Code § 481.121) | Up to 180 days, fine up to $2,000 |
| Selling hemp to someone under 21 | License revocation under DSHS rules | Loss of license |
How police in different Texas cities treat hemp THC
It varies by department, and that is one of the biggest risks. State law is the same everywhere, but local agencies chose different approaches to possession after July 31, 2026.
- Austin: Police said delta-8 possession would be a felony and that a delta-8 label can be enough for an arrest. They also said a lab report or label showing 0.3% delta-9 or less can show a product is legal hemp, and that enforcement is not a priority.
- Fort Worth and Dallas: Fort Worth police said possessing less than 0.3% delta-9 is legal. Dallas police said the DSHS THCA rule does not make possession automatically illegal.
- Round Rock and Hays County: Round Rock police pointed reporters to a state law library guide saying THCA became illegal. A Hays County Sheriff’s Office spokesperson said THCA will not be legal under the state’s rule, though a deputy said anything labeled hemp or 0.3% delta-9 would be treated as legal.
- Travis County: District Attorney José Garza warned that the risk of arrest is real, and also called enforcement incredibly difficult given the lack of clarity.
Real situations under the Texas THC ban
You buy delta-9 gummies at a Texas smoke shop
If you are 21 or older and the label shows a lab report with delta-9 at or under 0.3%, the purchase is legal. If the package says delta-8 or HHC, you are buying something the state is treating as a controlled substance or a legal gray area.
You are stopped in Travis County with a bag of THCA flower
THCA possession is unsettled, and the Department of Public Safety says courts decide legality. Austin police have described seizing a product and releasing the person, and a Travis County prosecutor decides any charge. Do not assume that a hemp label ends the stop.
You bring a THC cartridge home from another state
A cartridge that is legal where you bought it can still be a crime in Texas. A cartridge of marijuana oil is charged as a controlled substance, and hemp-derived cartridges cannot be sold here at all. See our marijuana penalties for how concentrates are charged.
You drive after using THC
A legal product does not protect you on the road. Driving while intoxicated by any substance is DWI under Penal Code § 49.04. Our driving and vehicle guides explain how DWI works in Texas.
Myths vs. facts about the Texas THC ban
| Myth | Fact |
|---|---|
| “Texas banned all THC.” | Hemp-derived delta-9 at or under 0.3% is still legal for adults 21 and older. |
| “Abbott signed the THC ban.” | Abbott vetoed Senate Bill 3 in June 2025. The July 2026 change came from a DSHS rule and a Texas Supreme Court ruling. |
| “A hemp label makes any product legal.” | A product must pass the 0.3% limit and, for finished products, the total THC test. |
| “A vape is fine if it is hemp.” | Selling any cannabinoid vape is a crime under Senate Bill 2024. |
| “Federal law protects hemp, so Texas cannot ban it.” | A federal judge in Galveston denied an emergency request to pause the Texas ban, and the request for a preliminary injunction is still pending. |
What happens next with the Texas THC ban
Several things are pending, and any of them could change the picture. The state’s appeal over the March rules, DSHS v. Texas Hemp Business Council, No. 15-26-00099-CV, is set for oral argument on December 8, 2026 in the Fifteenth Court of Appeals.
In federal court, the request for a preliminary injunction in Monti v. Garcia is still pending. The Legislature’s next regular session starts in January 2027, and hemp is likely to come up again.
Congress also changed the federal definition of hemp in November 2025. A law signed September 2, 2026 (H.R. 6500) moved most of the change to December 11, 2026, when finished hemp products over 0.4 milligrams of total THC per container stop counting as hemp. Cannabinoids the plant cannot make naturally still lose federal hemp status on November 12, 2026. Bills to delay or repeal the change have been introduced, but none has become law.
What to do if you are stopped or affected
Keep products in their original packaging and keep the lab report (certificate of analysis) for each one. Do not consent to a search, and do not discuss where you bought it. If you are charged, speak with a Texas criminal defense attorney before your first court date.
If you sell hemp, check your DSHS license, your ID-check process and your product test results against the current rules. Our cannabis, THC and substances guides follow each change.
Frequently asked questions
Is THC legal in Texas?
Partly. Hemp-derived delta-9 THC at or under 0.3% by dry weight is legal for adults 21 and older. Marijuana, delta-8, delta-10 and THCP are not legal for general use. Medical low-THC cannabis is available only to registered patients through the Compassionate Use Program.
Is delta-8 illegal in Texas?
Yes. Since July 31, 2026, delta-8 is treated as a controlled substance in Texas, except the trace amounts the hemp plant produces naturally. Possession can lead to felony charges, and sellers can lose their licenses and face criminal charges for distributing a controlled substance.
Are THC pens legal in Texas?
Retailers cannot legally sell them. Senate Bill 2024 bars the sale and marketing of vapes that contain any cannabinoid, with an exception for prescribed substances. A seller faces a Class A misdemeanor, and the ban has applied since September 1, 2025.
What is the age limit to buy THC in Texas?
You must be 21. DSHS emergency rules adopted in October 2025, since made permanent, bar licensed sellers from selling consumable hemp products to anyone under 21, and sellers must check a valid government-issued ID. A seller who breaks the rule can lose its license.
Is HHC legal in Texas?
It is unsettled. The July 31, 2026 change names delta-8, delta-10 and THCP, and we found no official Texas statement that clears HHC. Treat HHC as high risk until a court or the state says otherwise.
Did Abbott ban THC in Texas?
No. Gov. Abbott vetoed Senate Bill 3, a full hemp ban, on June 22, 2025. He later ordered an age 21 limit. The July 2026 restrictions came from a Texas Supreme Court ruling and a DSHS rule, not from a new statute.
Will the Texas THC ban change in 2027?
It could. The Legislature meets in January 2027 and can pass new hemp rules, and the courts may rule on the pending appeals sooner. A federal hemp definition change is also set for December 11, 2026. Check the date on this page for the latest update.
